The Regulation of Resilience: When Compliance Is No Longer Enough


For decades, transport regulation has largely focused on a central question:

Does the system comply?

Are vehicles built to standard?
Are procedures documented?
Are operators meeting legal obligations?
Are targets being achieved?

Those questions still matter.

But increasingly, modern transport systems are beginning to face a much bigger challenge:

What happens when systems fail?

That shift is becoming more visible internationally through discussions around UNECE Regulation 107 and wider conversations about emergency evacuation, operational resilience and degraded-system performance within buses and coaches.

It reflects something many frontline transport workers have understood for years:

A system can be fully compliant on paper and still struggle operationally in the real world.

That distinction matters enormously.

Because resilience is not truly measured during ideal operating conditions.

It is measured:
• during disruption;
• during infrastructure failure;
• during communication breakdowns;
• during extreme weather;
• during staffing shortages;
• during emergency evacuations;
• during operational pressure;
• and during the moments when human judgement matters most.

Modern public transport systems are becoming increasingly:
• digital;
• automated;
• interconnected;
• performance-managed;
• and data-driven.

Yet complexity itself introduces new vulnerabilities.

The more systems become dependent on:
• live tracking;
• remote management;
• digital communications;
• performance algorithms;
• scheduling software;
• and integrated operational platforms,

the more important resilience becomes.

Not theoretical resilience.

Operational resilience.

The ability for systems to continue functioning safely when conditions deteriorate.

This is where the debate becomes far bigger than vehicle specifications or technical compliance alone.

It becomes a governance issue.

Because resilience is shaped not only by engineering, but by:
• organisational culture;
• operational design;
• staffing levels;
• infrastructure investment;
• driver wellbeing;
• communication systems;
• maintenance standards;
• contingency planning;
• and whether frontline operational realities are genuinely understood by decision-makers.

Increasingly, transport systems risk becoming overly focused on measurable outputs while losing sight of operational conditions underneath them.

KPIs may show:
• punctuality;
• utilisation;
• efficiency;
• or target achievement.

But metrics alone rarely capture:
• fatigue;
• operational pressure;
• degraded decision-making;
• near misses;
• thermal stress;
• communication failures;
• passenger vulnerability;
• or frontline resilience under sustained pressure.

That gap matters.

Because public transport is not simply an engineering system.

It is a human system.

And resilient systems are not built purely through compliance frameworks.

They are built through:
• transparency;
• learning cultures;
• operational realism;
• frontline engagement;
• public accountability;
• and governance structures capable of understanding complexity rather than merely measuring outputs.

This is why resilience regulation may become one of the defining transport governance debates of the next decade.

Not simply:
“Is the operator compliant?”

But:
“How resilient is the system under stress?”

That is a fundamentally different question.

And one which increasingly sits at the centre of:
• safety;
• decarbonisation;
• integrated transport;
• franchising;
• digital operations;
• passenger confidence;
• and long-term public trust.

As transport systems evolve, regulation itself may also need to evolve.

Because ultimately, the true test of any transport system is not how it performs when everything goes right.

It is how safely, intelligently and humanely it performs when things start going wrong.
